Horrible Harry Wants To Make It Impossible To Repeal The Death Panel

Senate Leader Horrible Harry Reid (D-NV) will do anything to make sure the Independent Medical Advisory Board (in other words, The Death Panel) can never be repealed by future Congresses.  He put it in the wording of the Senate Health Care Monstrosity.  Senator Jim DeMint (R-SC) pointed this out on the floor of the Senate last night.

Is this Constitutional?  The Dems don't care if it's Constitutional; they are on a mission and nothing will stop them now.  According to Senator DeMint, the Dems are changing the rules.  Hey, so what's new?

Reid Bill Says Future Congresses Cannot Repeal Parts of Reid Bill

Senator Jim DeMint (R-S.C.) pointed out some rather astounding language in the Senate health care bill during floor remarks tonight. First, he noted that there are a number of changes to Senate rules in the bill--and it's supposed to take a 2/3 vote to change the rules. And then he pointed out that the Reid bill declares on page 1020 that the Independent Medicare Advisory Board cannot be repealed by future Congresses:
there's one provision that i found particularly troubling and it's under section c, titled "limitations on changes to this subsection."
and i quote -- "it shall not be in order in the senate or the house of representatives to consider any bill, resolution, amendment, or conference report that would repeal or otherwise change this subsection."
this is not legislation. it's not law. this is a rule change. it's a pretty big deal. we will be passing a new law and at the same time creating a senate rule that makes it out of order to amend or even repeal the law.
i'm not even sure that it's constitutional, but if it is, it most certainly is a senate rule. i don't see why the majority party wouldn't put this in every bill. if you like your law, you most certainly would want it to have force for future senates.
i mean, we want to bind future congresses. this goes to the fundamental purpose of senate rules: to prevent a tyrannical majority from trampling the rights of the minorityor of future congresses.

  1. Horrible Harry fits him quite well. This is unconstitutional. I hate to say this but I think its time for both the Republicans and us to fight back dirty against the passage of Obamacare. I think we need to pin Dems in the House against Dems in the Senate somehow. I am trying to think up a plan now.

    I heard today that at least one Dem from the House is changing his affiliation to Republican. I wonder how many other so-called moderate Dems will decide it's to their benefit to cross over to the GOP. I'm not sure I want any more moderates in the GOP...we have enough of them already.
    Good luck with your plan. I fear the Dems are going to forget their differences over the bill and vote on the Senate bill as the final thing just to get the bill on Obummer's desk before the State of the Union Speech. I would much rather see them ripping each other apart over abortion and the public option. Maybe Santa will grant my wish, ha.

  4. Things like this are why we didn't see the bill until the last minute. It's brilliant on the Dem's part (completely unethical, mind you). They create a bill in secret. They don't let anyone see it. All the Senators are in DC, and will not have to face their constituents until the vote is over. We didn't have the bill, so we couldn't say what was or was not in it. The Republicans were in the same boat. They got to strangle off any dissent before it even had a chance to happen.

  6. I don't claim to fully understand the US Constitution but I know that it is very clever and would be most surprised if an Administration could tie the hands of any future one in the way being suggested.

    Now you know why they are dragging their feet waiting till Christmas.

    Once "We the People, Children" tear off the superfluous paper, bows and ribbons we just got another lump of coal.

    I say burn it and use the energy to shock them out of office in 2010.

    They think we are children, so let us give them a real tantrum to contend with.

    It's probably unconstitutional, but I don't think the Dems really care anymore. It's their chance to do what they've wanted to do for many, many years and they are not going to pass it up. Hopefully, this will be challenged by the Republicans. I think Senator DeMint will pursue it.

    I hope your Christmas was wondrful.

    It is about time that both parties stop passing legislation that is probably unconstitutional. But, it is going to keep on happening until some organization decides to fund lawsuits to bring all of those bills before the Supreme Court. I hope it happens before Obama gets enough appointees onto the court to throw out such challenges.

    I heard that some attorneys general from various states are looking into the constitutionality of the House and Senate shenanigans regarding their health care bills. I sure hope they can make a case against this tyrannical gov't. Something has to be done.
