To Hell With Congress

A judge finds Obama's federally funded stem cell research illegal because it violates the will of Congress.  Now Obama is planning to find a way around this decision. 

I'm sure he will.  Congress is becoming irrelevant.  Maybe he'll appoint a "Stem Cell Czar" or write an executive order or "deem" it legal or something...

VINEYARD HAVEN, Mass. (AP) - The White House says federally funded stem cell research should continue and is exploring how to respond to a judge's order halting it. President Barack Obama, who last year ordered stem cell research expanded, "thinks that we need to do research, he put forward stringent ethical guidelines and he thinks that his policy's the right one," Deputy Press Secretary Bill Burton told reporters Tuesday.
Burton said the administration was exploring all possible avenues "to make sure that we can continue to do this critical lifesaving research" after a federal judge Monday ruled Obama's policy on stem cells illegal. He issued an injunction that temporarily blocks government rules expanding stem cell research.
Asked if it might take new legislation from Congress to counter the ruling from U.S. District Judge Royce Lamberth, Burton said all possibilities were being explored.
In his ruling, Lamberth concluded that federally funded stem cell research violated the will of Congress, which has prohibited federal funding for research in which a human embryo is destroyed.
President George W. Bush had allowed federally funded research on 21 existing stem cell lines. Obama expanded—up to 75 so far—the number of stem cell lines created with private money that federally funded scientists could research. To qualify, the NIH insisted on evidence that the woman or couple who donated the original embryo did so voluntarily and were told of other options, such as donating to another infertile woman.
But Lamberth found in his ruling that the approach still amounted to a violation of Congress' ban on federal funding for research that destroys human embryos.
The administration's view is that the ruling would prohibit even the more limited stem cell research allowed by Bush, Burton said.

  2. If necessary he'll just disobey the judges orders like he did with the drilling moratorium in the Gulf. In that situation he hasn't disobeyed the letter of the law, he just hasn't allowed any permits to be issued. Thank God he jnows so much, huh? Where would the rest of us be without his divine insight? And I agree with you, Congress is allowing themselves to become irrelevant by not fighting openly with obama (or should I say at all). But rest assured, if a Republican gets into office - especially a conservative one - you'll see constant, bitter fighting between Congress and the President. We better be successful throwing out some progressives in November!

  3. Sounds real simple to me. The people don't want to pay for. It's one thing to rule against the peoples wishes, and quite another to ask them to pay for it.

    This has become the norm for Obama. His whole plan from the beginning was to acquire so much power for the Executive Branch that he could get around anything the law tried to stop him from doing. And he's been successful.
    If a Republican wins the White House the next time around, not only will he/she be fighting with the Dems in Congress, but the media will be fighting against him/her, too.

  9. TCL, I heard about this but missed the point that judge's ruling came about because it was against the will of congress. Now that is extraordinary.

  11. I agree entirely on the points about Obama, as you would already guess. But on the topic of stem cell reasearch itself (which I understand was not the real drive behind the post), I usually differ from my friends on the right. I agree with stem cell research, and wish more inroads could be made in this area.

    I did a post awhile back on stem cell research. Apparently there is better success using "adult" stem cells. Here's the post:

    I think Obama's research is geared toward using "embryonic" stem cells, which according to the article, has failed. I also think that most Americans don't want to fund "embryonic" stem cell research.
    As far as I'm concerned, the Congress (and the judge) got this one right. Obama is just doing what he does best...going against the will of the majority of Americans.
    On a person note...I am pro-life, so I don't think our tax dollars should be used on research that is based on the destruction of human life. I think adult stem cell research is absolutely good science and should continue to be explored.
